Terms of Use

DraftLast updated: [date]
Draft. This is a plain-language starting point, not legal advice. Have a lawyer review it, fill in the bracketed details, and remove this notice before the App Store launch.

These terms are an agreement between you and [company legal name] ("Comuna", "we", "us") for using the Comuna app and website (the "Service"). By using Comuna you agree to them. If you don't agree, please don't use the Service.

Using Comuna

  • You must be at least 13 years old to use Comuna. Some events are for adults only; follow each event's age rules.
  • Keep your account to yourself, and tell us if you think someone else is using it.
  • Comuna is in beta. Features may change, break or disappear while we build it.

Events and places

We gather event information from hosts and public sources and do our best to keep it accurate, but times, prices and details can change. Check with the host before you go. Events are run by their hosts, not by Comuna, and we aren't responsible for what happens at them. Use good judgment and look out for each other.

Points, stamps and patches

Points, stamps, patches and leaderboard positions are for fun and have no cash value. They can't be sold or transferred. We may adjust them to fix errors or stop abuse, such as fake check-ins. If rewards from hosts are offered, the host's own terms apply.

What you share

You own what you send us, such as feedback, event submissions and host information. You give us permission to use it to run and improve Comuna, including showing submitted events on the map. Only submit things you have the right to share.

Things you can't do

  • Break the law or anyone's rights through Comuna.
  • Submit false events, fake check-ins, spam or harmful content.
  • Interfere with the Service, scrape it, or try to access accounts or data that aren't yours.

We may suspend or remove accounts that break these rules.

Hosts

If you list a venue or event, you confirm the information is accurate and that you're allowed to host it. Any paid hosting plans will have their own terms, which we'll share before you're charged.

Our content

The Comuna name, logo, designs, stamps and patches belong to us. Please don't use them without permission.

Disclaimers and liability

Comuna is provided "as is". To the extent the law allows, we don't make warranties about the Service and aren't liable for indirect or consequential damages, or for events run by third parties. Our total liability to you is limited to [$100] or the amount you paid us in the last 12 months, whichever is greater.

Apple

If you use Comuna on an Apple device, Apple is not a party to these terms and isn't responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them.

Changes and ending

We may update these terms. If changes are significant we'll tell you in the app. You can stop using Comuna and delete your account at any time.

Law

These terms are governed by the laws of the State of California, and disputes will be handled in the courts of Los Angeles County. [Confirm with counsel.]
